When White Resistance Chokes Judicial Compliance

Whites suck at compliance with lawful orders. A horrible event happened when the Justices added “deliberate” to the 1954 Brown v. Board decision. That single word seems to purposely chose to imply utmost haste even when the Court meant “There’s no time schedule.” When courts find violations of law for white men in particular, they seem to be gauging the violent white reaction to Constitutional compliance that will ensue. That is what the Brown decision showed.

White conservative MAGA or Confederates have a history of extreme foot dragging, and they are given all the extra time. Usually, years can roll by as they plot and plan new laws and ways around the barriers courts or Constitution insist on. Since they’ve always had supermajority power in the South in particular, there is no way to force them to comply, since they are in power and are holding the guns.

This phrase from Brown is often repeated without a dictionary nearby. The word “deliberate” was added in 1955 as a clarification of Brown to mean, “No seriously, y’all need to desegregate,” but the catch was at a “deliberate” pace. The word to the white Southerners who were the one region fully not in compliance, as opposed to the North that where segregation had long been illegal, meant…
