The Profound SCOTUS Victory of a 94-Year-Old Black Woman
Systemic Robbery of Black Property Was Just Ruled Unconstitutional
Wow, it was an overwhelming historic day for the Supreme Court. I had to be shocked. It’s a moral reversal for black America as I see it. The court decided in Tyler v. Hennepin for a black American elderly homeowner over the state that had been repressing her, and thousands before her, in a slam-dunk 9–0 ruling. I can’t even begin to process this outcome.
As it turns out, some state governments have been flagrantly violating the Constitution, seizing property like homes, and putting excessive fines. In my own words, the punishments far outstrip the crime. These states put excessive punishments for relatively minor infractions. Yeah, that sounds like a black American issue. There is a second dimension to this historic ruling, but I am reviewing it separately, as it perhaps has even larger implications.
In this case, a 94-year-old black woman in Hennepin County, where Minneapolis is located, lost her house. She had not paid $2,300 in back taxes. The state government, always glad to lean on a poor black American in distress — an oblique reference to the George Floyd since that’s the state and county he was murdered in and it’s been 3 years now, peace to him — seized the home she completely owned.
